1. General Provisions

1.1. The controller of your personal data collected through the Service https://www.fkd.pl is GRUPA FKD Sp. z o.o., ul. Zbąszyńska 8a, 60-359 Poznań, Poland.

1.2. You can contact the Controller through the contact details of the Data Protection Officer at the Controller by phone: +48 61 662 57 16, or by e-mail: iod@fkd.pl.

1.3. In case of any doubts or requests regarding the exercise of your rights, please contact the Data Protection Officer at: iod@fkd.pl.

1.4. Your personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR).

1.5. We take special care to protect the interests of data subjects, and in particular we ensure that the data we collect is:

1.5.2. collected for specified, lawful purposes and not further processed in a manner incompatible with those purposes,

1.5.3. accurate and adequate in relation to the purposes for which they are processed and kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the data are processed.

2. Purpose and Scope of Data Collection and Legal Basis

2.1. The purpose, scope and recipients of data processed by the Controller result from the actions you take in the Service.

2.2. When creating an account, you should provide an email address and password, and after registration approval, also a shipping address and billing addresses. The data will be used to verify the user and facilitate the order process.

2.3. When placing an order in the Service, you will be asked to provide: payment method, delivery method, name and surname, email address, phone number, shipping address, invoice address, tax identification number and company name. The data will be used solely for the purpose of fulfilling the order in accordance with the Terms and Conditions.

2.4. When subscribing to the newsletter, you will be asked to provide an email address to which the Data Controller will send newsletter messages (including commercial and marketing information).

2.5. When submitting a question through the contact form, you will be asked to provide an email address to which the Data Controller will send a response.

2.6. For the purposes specified in 2.1-2.3, the legal basis for data processing is the necessity for the performance of a contract for the provision of services (Article 6(1)(b) GDPR).

2.7. For the purposes specified in 2.4-2.5, the legal basis for data processing is consent (Article 6(1)(a) GDPR).

2.8. You are not profiled, which means that your data is not processed in an automated manner to determine (estimate) your needs or personality traits. We do not collect additional information about you from other sources.

3. Data Recipients

3.1. The recipients of personal data will be other entities providing appropriate services related to the maintenance of the Service, hosting, administration and service management, entities cooperating with the Controller in providing services, consulting and legal companies. These entities process your data solely on the instruction of the Controller and on the basis of an appropriate data processing agreement.

4. Data Storage and Deletion

4.1. The Controller declares that it carefully selects and applies appropriate technical and organizational measures to ensure the protection of processed data. In particular, the Controller protects data against disclosure to unauthorized persons, as well as against processing in violation of applicable law. The Controller exercises constant control over the data processing process and limits access to data as much as possible, granting appropriate authorizations only when necessary for the proper operation of the service.

4.2. We strive to minimize the retention period for personal data that is no longer being used. However, we inform you that this may occur for operational and technological reasons. By this, we mean the time needed to decide whether further contact is advisable, as well as the time needed to delete data from backup copies.

4.3. Personal data obtained in connection with the creation of your account and placing an order may be processed throughout the period of holding the Account and using the service.

4.4. Your data obtained for the purpose of handling an inquiry will be processed by us for the duration of the correspondence, and then, depending on the results, will either be added to our contractors database and further processed for the purpose of contract performance, or - if cooperation is not possible - will be deleted after 12 months from the date of sending the last message.

4.5. Data processed on the basis of consent, used for sending marketing information, will be processed until consent is withdrawn. Additionally, a period of 30 days is required for us to delete them from backup copies.

5. Right to Withdraw Consent, Right to Control, Access and Rectify Your Data, Right to Data Portability, Right to Object to Further Processing, and Right to Lodge a Complaint with a Supervisory Authority

5.1. We inform you that we process your data for marketing and recruitment purposes based on your voluntary consent. We inform you that this consent can be withdrawn at any time. We suggest sending us a message from the same email address to which you receive marketing content. The sole consequence of withdrawing consent will be that you will no longer receive marketing content from us. We also inform you that withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

5.2. You have the right to access the content of your personal data and to rectify it.

5.3. If you find yourself in a particular situation where further processing of your data by us threatens your privacy, you may notify us of this fact and request that we cease or restrict processing.

5.4. You also have the right to request that we transfer your data to another entity in a format that the recipient can freely process. We inform you that this right applies only to the data we have received from you. Given that data about you is processed in text form, data transfer will consist of us generating text documents in docx format containing your inquiry history. These documents will not contain our responses, as they are not subject to your right (they are not transferable).

5.5. We inform you that you also have the right to lodge a complaint with the supervisory authority, the President of the Personal Data Protection Office (address: Urząd Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw, Poland).

6. Cookies

6.1. The Controller's website uses cookies. Cookies are IT data, in particular text files, which are stored on your end device and are intended for using the website pages of the service. Cookies usually contain the name of the website from which they come, the time of their storage on the end device, and a unique number. Failure to change your browser settings is equivalent to consent to their use.

6.2. The installation of cookies is necessary for the proper provision of services on the website. Cookies contain information necessary for the proper functioning of the website.

6.3. Within the website, cookies are used in particular for the purpose of preparing statistics that help understand user preferences and behaviors. The analysis of these statistics is anonymous and allows for the adaptation of the content and appearance of the service to prevailing trends. Statistics are also used to evaluate the site and its functionality.

6.4. Within the Service, two main types of cookies are used:

6.5. Session cookies are temporary files that are stored on the User's end device until logging out, leaving the website, or closing the software (web browser). Persistent cookies are stored on the User's end device for the time specified in the cookie parameters or until they are deleted by the User.

6.7. In many cases, software used for browsing websites (web browser) by default allows the storage of cookies on the end device. You, as users of the Service, can change the settings for cookies at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or to notify about their placement on the end device. 7. Cookies placed on the end device may also be used by advertisers and partners cooperating with the service operator.

9. Changes to the content of this Privacy Policy may only occur after prior notification of Users of the intended changes no later than 2 (two) weeks before the date of their entry into force. Orders placed before the changes take effect will be processed according to the version of the Privacy Policy that was in effect at the time of placing the order. If a registered User does not consent to the content of the changes being introduced, they have the option to delete their account from the online store.
